Pro-Motion Technology Group, LLC ("PTG," "we," "us," or "our") operates the website at promotion.tech (the "Site"). This policy explains what information we collect through the Site and when you choose to email or call us, how we use it, who we share it with, and the choices you have.

This policy covers the Site only. It does not cover information we process on behalf of our clients when we design, install, or support technology environments for them. In those engagements we act as a service provider under our contract with that client, and the client's own privacy policy governs.

By visiting our Site, providing information to us (by any means, whether in correspondence, via our Site, or otherwise), or continuing to use our services, you acknowledge that you have read, understood, and consent to be bound by this Privacy Policy.

IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY OR OUR PRACTICES, YOU MAY NOT USE OUR SITE. THIS PRIVACY POLICY MAY CHANGE FROM TIME TO TIME AND YOUR CONTINUED USE OF OUR SITE CONSTITUTES YOUR ACCEPTANCE OF THOSE CHANGES. WE ENCOURAGE YOU TO REVIEW THIS PRIVACY POLICY PERIODICALLY.

Information we collect

Information you give us. When you submit our contact form, we collect your first and last name, business email address, company name (optional), industry (optional), telephone number (optional), the content of your message, and whether you opted in to marketing emails.

If you email hello@promotion.tech or call us, we collect whatever you choose to include.

Information collected automatically. When you visit the Site, we and our analytics providers collect:

  • Your IP address and the approximate city or region derived from it
  • Your browser type, language, device type, and operating system
  • The pages you view, how long you spend on them, and the links you click
  • The referring site, search terms, or campaign parameters that brought you here
  • The date and time of your visit

We collect this information using cookies and similar technologies, as further described in the "Cookies and tracking technologies" section below.

What we don't collect. We do not knowingly collect Social Security numbers, financial account numbers, government ID numbers, precise geolocation, biometric data, or health information through the Site. Please don't include information of that kind in the message field of our contact form.

  • To comply with legal obligations and to establish, exercise, or defend legal claims

We may also anonymize, aggregate or de-identify personal information so the end-product does not identify you or any other individual. Such aggregated, anonymized or de-identified information is not considered personal information for purposes of this Privacy Policy and we may use it for any purpose. For example, we may use this information to generate norms by industry, geography, level, etc., enable us to understand where our services are being utilized, conduct ongoing validation studies, compile reports, and improve the services.

We do not use your information for any automated decision-making that produces legal or similarly significant effects.

Promotional Communications

We may use your information to send you updates (by email, text message, telephone or post) about our products or services, including exclusive offers, promotions or new products or services.

We have a legitimate interest in processing your personal information for promotional purposes (see below "How and why we use your personal information"). This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly.

You have the right to opt out of receiving promotional communications at any time by:

  • Contacting us by using one of the methods listed in the "Contact Us" Section below; or
  • Using the "unsubscribe" link in emails or "STOP" number in texts.

We may ask you to confirm or update your marketing preferences if you instruct us to provide further products or services in the future, or if there are changes in the law, regulation, or the structure of our business.

Cookies and tracking technologies

Cookies are small text files a website stores on your device. They let a site recognize your browser across visits and measure how it's used. We may use these cookies to collect browsing data to keep track of your preferences and profile information and to collect general usage and volume statistical information. We also use related technologies — tags, pixels, and local storage — and refer to all of them here as cookies.

There are a number of different types of cookies, however, the Site uses:

Essential. These cookies are necessary to the core functionality of our Site and some of its features, such as access to secure areas. For example, our images and content are served by Prismic. Requests to that service transmit your IP address and browser information to Prismic so the content can be delivered. This is necessary for the Site to display. We also use __cf_bm through various third parties which distinguishes humans from bots and lasts thirty minutes.

Performance and Functionality. These cookies are used to enhance the performance and functionality of our Site. For example, we may use these cookies so that we recognize you on our Site and remember your previously selected preferences. These could include what language you prefer and your geographic location. These cookies are nonessential to the use of our Site, however, without these cookies, certain functionality may become unavailable. For example, HubSpot sets a cookie named hubspotutk that assigns your browser a unique visitor identifier for user authentication and lasts six months.

Analytics. These cookies distinguish unique visitors, maintain session state, and limit the rate of requests. They are named _ga, _ga_ followed by a property identifier, _gid, and _gat, and they last from one minute to two years depending on their function. PTG uses these cookies and technologies to analyze how the Site is accessed, used, or performing in order to improve your user experience and to maintain, operate and continually improve the Site. For example, we use Google Analytics on the Site to collect: page url/page title and user browser/system information, which includes browser type, referrer, language, java/flash support, IP address, and ad-serving data. Google's practices are described at policies.google.com/technologies/partner-sites. You can opt out of Google Analytics on any website by installing the browser add-on at tools.google.com/dlpage/gaoptout. HubSpot also sets __hstc, which records your first visit, most recent visit, current visit, and session count for website analytic purposes and lasts six months; __hssc, which tracks page views within your current session for website analytic purposes and lasts thirty minutes; __hssrc, which detects whether you have restarted your browser for website analytic purposes and expires when your session ends. Before you ever contact us, HubSpot records your visits anonymously against a browser identifier. If you later submit our contact form, the pages you viewed beforehand — including on earlier visits — become visible to us as part of your contact record. If you would rather that not happen, clear your cookies before submitting a form, or block cookies as described below.

Web Beacons. Our Site contains electronic images known as web beacons (sometimes called single-pixel gifs) and are used along with cookies to compile aggregated statistics to analyze how our Site is used and may be used in some of our emails to let us know which emails and links have been opened by recipients. This allows us to gauge the effectiveness of our customer communications and marketing campaigns. We use a third party to gather information about how you and others use our Site. For example, we will know how many users access a specific page and which links they clicked on. We use this aggregated information to understand and optimize how our Site is used.

Your cookie choices. You have the right to decide whether to accept or reject certain cookies. All major browsers let you block or delete cookies through their settings, and most offer a private browsing mode that discards cookies when you close the window. Instructions are in your browser's help documentation. You can also use the industry opt-out tools at optout.aboutads.info and youradchoices.com. However, in a few cases, some of our Site features may not function as a result. Essential cookies cannot be rejected, as they are strictly necessary to provide you with our Site.

Do Not Track. The Site does not currently respond to browser Do Not Track signals.

Global Privacy Control. 'Global Privacy Control' (GPC) is a browser setting that allows users to automatically communicate their preference to opt out of data sharing or selling across different websites. When you enable a GPC setting in your web browser, you are signaling to websites that you wish to opt out of the sale or sharing of your personal information across all websites that recognize this signal. If you have enabled a GPC signal on your browser, we will automatically process your request to not sell or share your personal information.

How we share your information

We do not share your personal information with any third party for cross-context behavioral advertising.

We may disclose your information to the following third parties:

Our Service Providers. We disclose your information to third parties that provide business, professional, or technical support services to us and/or administer activities on our behalf, each of which is permitted to use it only to provide services to us:

  • HubSpot, Inc. receives your form submissions, contact details, and on-site activity, and provides our CRM, marketing automation, and email delivery.
  • Google LLC receives site usage data, your IP address, and device data, and provides analytics and tag deployment. This assists us in performing analytics and helps us measure the effectiveness of the Site and our marketing and advertising efforts.
  • Netlify, Inc. receives server logs and your IP address, and hosts and delivers the Site.
  • Prismic SAS receives content requests and your IP address. This assists us with delivering our content and images.

Our professional advisors. We disclose your information to our legal, accounting, and insurance partners as needed to protect our legitimate business interests.

Our Business Partners. We disclose your information to other companies with whom we partner to provide the Site and our products or services, to promote our products, services, offers, contests, or other promotions to our customers, and carry out other activities described in this Privacy Policy.

Our Marketing and Advertising Partners. We disclose your information to our marketing and advertising partners, including social media networks, third-party advertising networks, and other parties that assist us in serving, measuring the performance of, and optimizing our advertisements.

Governmental and Public Authorities. We disclose your information to government and public authorities as necessary or permitted by the laws of any jurisdiction in which we operate, including in response to a subpoena, court order, investigative demand, request for cooperation from a law enforcement agency, or other legal process or request from a self-regulatory body or government agency, or where we believe disclosure is necessary to protect our rights or someone's safety;

Relevant Third Parties in Connection with a Business Transaction. We may disclose or otherwise transfer your personal information to an acquirer, successor, or assignee as part of a merger, acquisition, financing, or sale of our business or assets, or similar transaction, as well as in the event of any insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.

We may also need to share some personal information with other parties to the extent we believe it is necessary or appropriate to (1) protect our operations and those of our affiliates and subsidiaries; (2) investigate and prevent against fraud and other illegal activity; (3) protect our rights, privacy, safety, property, and/or those of others; or (4) allow us to pursue available remedies or limit damages that we may sustain.

We may disclose your personal information for other reasons described at the time of information collection or prior to disclosing your information. Additionally, we may disclose your personal information with your consent or when you direct us to do so.

Except as set forth above, we will not share your personal information with any other third party.

How long we keep your information

We will not retain your personal information for longer than necessary for the purposes set out in this Privacy Policy. Different retention periods apply for different types of personal information. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of personal information; the potential risk from unauthorized use or disclosure of the personal information; the purpose(s) for which we use or may use the personal information; whether we can achieve the purpose(s) through other means; and the applicable legal requirements.

We keep contact form submissions and the CRM records created from them for three years from your last interaction with us, unless you ask us to delete them sooner. If you subscribe to marketing email, we keep your subscription until you unsubscribe, and then keep a suppression record indefinitely so that we do not contact you again by mistake. Server logs are kept for ninety days. Analytics and cookie data are kept for the durations described in the "Cookies and tracking technologies" section above.

We keep information longer where we are required to by law or where it is needed to establish, exercise, or defend a legal claim.

How we protect your information

We use reasonable and appropriate administrative, technical, and physical safeguards designed to protect personal information, including TLS encryption for data in transit, access controls limiting internal access to personnel who need it, and vendor agreements requiring our service providers to maintain appropriate security.

Please note, however, no system can be completely secure and no method of transmission or storage is completely secure. Therefore, although we take steps to secure your information, we cannot guarantee absolute security of your information, searches, or other communications. Any such transmission of information by you over the internet is at your own risk.

A Note to Users Outside of the United States

Information may be held at our offices and those of our third party agencies, service providers, representatives and agents as described above (see above: "How We Share Your Personal Information").

PTG is headquartered in the United States of America ("U.S.") and utilizes service providers in the U.S. If you are a non-U.S. user of the Site, by visiting the Site and providing us with data, you acknowledge and agree that your information may be processed for the purposes identified in this Privacy Policy. If you choose to access our Site outside the U.S., PTG and our service providers may transfer your personal information to, or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. In particular, you are advised that the U.S. uses a sectoral model of privacy protection that relies on a mix of legislation, governmental regulation, and self-regulation. Where the laws of your country allow you to do so, by using the Site or purchasing our products or services or by providing your data, you consent and authorize PTG to transfer, store, and use all such personal information in the U.S. (and any other country where we or our third party service providers may operate) which may not offer an equivalent level of protection to that required in the country where you reside and to the processing of that information by us on our servers located in the U.S., as described in this Privacy Policy. If you do not want your information transferred to the U.S. and any other country where we or our third party service providers may operate, please do not submit any information to us or use our Site or purchase products or services.

Your rights and choices

Children

The Site is directed to businesses and is not intended for children. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected or received personal information from a child under 13 without verification of parental consent, in compliance with the Children's Online Privacy Protection Act, we will purge such information from our database and cancel the corresponding accounts. If you believe a child has given us information, contact us and we will delete it.

Third-party sites

The Site links to third-party websites and social media profiles and may embed third-party content such as video players. Those parties collect information under their own policies, which we do not control, and our links to them are not endorsements. Interacting with embedded content can allow the host to set cookies and track you as though you had visited their site directly, including tying that activity to your account with them if you are logged in.

As such, we urge that you exercise caution before providing third parties with your information or interacting with embedded third-party content and to review the third party's privacy policy for information on its data processing practice.

You should contact the site administrator for such third party website if you have any complaints, claims, concerns or questions regarding such third party website or its privacy practices.

California Civil Code Section 1798.83, also known as the "Shine The Light" law permits individuals who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. We do not disclose personal information that corresponds to the categories of personal information set forth under Cal. Civ. Code § 1798.83 to third parties for the third parties' direct marketing purposes.

In connection with any personal information we may sell or disclose to a third party for a business purpose, you have the right to know:

You have the right under the CCPA and CPRA and certain other privacy and data protection laws, as applicable, to opt-out of the sale or sharing for cross-contextual behavioral advertising of your personal information. If you exercise your right to opt-out of the sale or sharing for cross-contextual behavioral advertising of your personal information, we will refrain from selling or sharing for cross-contextual behavioral advertising your personal information, unless you subsequently provide express authorization for the sale or sharing for cross-contextual behavioral advertising of your personal information. To opt-out of the sale or sharing for cross-contextual behavioral advertising of your personal information, click the "Do Not Sell or Share My Personal Information" link in the footer of any page on the Site and turn off advertising cookies in the preferences panel that opens.

Right to Limit Use and Disclosure of Sensitive Personal Information

We do not collect any sensitive personal information.

Right to Correction

Subject to certain exceptions, on receipt of a verifiable request from you, we will:

  • Direct any service providers to delete your personal information from their records.

You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things:

  • Deny goods or services to you;
  • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  • Provide a different level or quality of goods or services to you; or
  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that we may charge a different price or rate or provide a different level or quality of goods and services to you, if that difference is reasonably related to the value provided to our business by your personal information.

The Right to Data Portability

How to Exercise Your Rights

If you would like to exercise any of your rights as described in this Privacy Notice, please:

Please note that you may be restricted on the number of data access or data portability requests you may make within a 12-month period.

If you choose to contact us to exercise your rights, we will take steps to verify your identity before granting you access to your personal information or complying with your request. In order to help protect your privacy and maintain security, you will need to provide us with:

  • Enough information to identify you (e.g., your full name, address, email address, telephone number, birth date, or customer or matter reference number);
  • Proof of your identity and address (e.g., a copy of your driving license or passport); and
  • A description of what right you want to exercise and the information to which your request relates.

In addition, if you ask us to provide you with specific pieces of personal information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.

You may use a representative, called an "authorized agent," to submit a request to us.

In some states, an authorized agent must be a natural person, or a business entity registered with the appropriate Secretary of State, that you have authorized to act on your behalf.

In order to protect your privacy, PTG requires you to confirm that you have provided the authorized agent permission to submit the request and you must provide the authorized agent with signed permission. "Signed" means that the written attestation, declaration, or permission has either been physically signed or provided electronically pursuant to the Uniform Electronic Transactions Act. In California, an authorized agent that has power of attorney pursuant to California Probate Code section 4121 to 4130 must submit proof of statutory power of attorney, but in such cases, consumer verification will not be required.

PTG may deny a request from an authorized agent that does not submit proof that they have been authorized to act on your behalf. Requests submitted by an authorized agent will still require verification of the person who is the subject of the request in accordance with the process described above.

We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information, or is someone authorized to act on such person's behalf.

Any personal information we collect from you to verify your identity in connection with you request will be used solely for the purposes of verification.
